By downloading or using the ArriveAwake application, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.

CRITICAL DISCLAIMER: ArriveAwake is a tool to assist you in monitoring your transit progress. It is NOT a substitute for personal vigilance. You are solely responsible for being aware of your surroundings and ensuring you reach your destination safely.

1. Limitation of Liability

Chenglian Consulting provides ArriveAwake on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the reliability or accuracy of the application.

In no event shall Chenglian Consulting be liable for any damages, including but not limited to:

Missed transit stops or destinations.
Financial losses (tickets, alternate transportation, etc.).
Loss of time or employment-related consequences.
Any indirect, incidental, or consequential damages arising from the use or inability to use the app.

2. Technical Requirements & Dependencies

The app's performance is strictly dependent on external factors beyond our control, including:

GPS Signal: Tracking may fail in tunnels, subways, between tall buildings, or during severe weather.
System Termination: iOS may terminate background processes to save battery or manage resources.
Hardware Failure: Device malfunctions or battery depletion.

3. Battery Usage

Use of GPS running in the background can significantly decrease battery life. We recommend charging your device during long transit journeys.

4. In-App Purchases

ArriveAwake Pro is offered as a one-time purchase. All sales are final and managed through the Apple App Store. We do not have access to your billing details or the ability to issue refunds directly.

5. Changes to the App

We are committed to ensuring the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason.

6. Termination & Discontinuation of Service

Chenglian Consulting reserves the right to modify, suspend, or discontinue ArriveAwake (or any part thereof), including its availability on the Apple App Store, at any time and for any reason, with or without notice. In the event of such discontinuation:

You acknowledge that your license to use the app may be terminated.
Chenglian Consulting is under no obligation to provide refunds, credits, or other compensation for any discontinued service or features.
Access to previous purchases (including "Pro" features) may become unavailable if the app is removed from Apple's servers.

7. Amendments

We may update these Terms of Use from time to time. Your continued use of the app following the posting of any changes constitutes acceptance of those changes.

8. Agreement

By using ArriveAwake, you agree to these terms. If you do not agree, do not download or use the application.
